A buyout is usually the answer if this is you
| YOUR SITUATION | WHY THIS LOAN FITS | GO TO |
|---|---|---|
| You are keeping the house | Refinancing into your sole name is how the other party is released | Refinance options → |
| You are the one leaving | You stay liable until the loan is refinanced or repaid, not when the decree is signed | Talk to us → |
| You need to release equity to settle | A cash-out can fund the settlement and remove the name in one move | Cash out refinance → |
| Your income changed with the separation | Support payments count on both sides, and how they are documented matters | Self-employed → |
| Your attorney is drafting the agreement now | This is the right moment to talk to us, before the wording is fixed | Talk to us → |

What a buyout file needs
The separation agreement, or a draft
How the property and support are worded affects what a lender can do.
A current value
Usually an appraisal, since the equity split depends on it.
Income in one name
What used to be supported by two incomes now rests on one.
Support payments documented
Received support can often count as income. Paid support counts against you. Both need evidencing.
A credit history the lender can price
Separations are hard on credit. Recent history matters, and different lenders read it very differently.
Time
This is not a file to start the week the decree is signed.
No rates or figures here on purpose. Yours depend on your credit, the county and the program. A licensed loan officer gives you real numbers on the call.
What to watch for, and we will not bury it
A decree does not remove you from a mortgage
This is the most costly misunderstanding here. Until the loan is refinanced or repaid, both names remain liable regardless of what a court ordered.
The agreement wording can help or hinder
How support and the property transfer are drafted directly affects what a lender can approve. Talk to us before it is finalised, not after.
Support usually needs a history and a continuance
Lenders typically want to see it has been paid and will continue. Payments starting next month rarely count yet.

What people ask during a separation
Does the divorce decree remove me from the mortgage?
No. A court can order who is responsible between the two of you, but the lender is not bound by it. Only a refinance, an assumption or repayment removes a name.
Can I buy out my ex-partner’s share?
Usually, through a refinance that releases equity to them and puts the loan in your sole name.
Does child support or alimony count as income?
Received support often can, if there is a history of payment and evidence it will continue. Paid support counts against you.
What if my credit suffered during the separation?
Very common, and not automatically disqualifying. Different lenders take markedly different views of recent history.
When should I start this?
While the agreement is still being drafted. The wording affects what is possible, and by the time it is signed the options have narrowed.
